On the protection of the rights and interests of over-age workers from the perspective of retirement rights

Abstract

The protection of the rights and interests of over-age workers has come to the forefront with the advent of an aging society in China. As a right of workers, the right to retirement should be an important perspective for analyzing over-age labor relations. In the current protection of the rights and interests of overage workers in China, due to the neglect of the right to retirement, there are three major difficulties: the nature of “over-age employment relationship” is blurred, the unfairness of “over-age” determination for men and women, and the weak awareness of over-age workers to protect their rights. In this regard, we should build a flexible retirement model, realize the freedom of employment of over-age workers, gradually narrow the gap of “over-age” recognition, clarify the content of the rights of over-age workers, and further improve the relevant supporting mechanisms in order to effectively realize the protection of the rights and interests of over-age workers.
